General Terms and Conditions of Use
These Terms of Use were revised on 1/06/2016. This version replaces all previous editions.
These Terms of Use are intended to define the conditions and procedures for the booking of personalized special offers created by hotels on the « direct-booking.com » site.
Article 1. General Information
The service is restricted to those legally capable of entering into contracts under law. The term Member shall refer to any persons who register on the site at « http://www. direct-booking.com » The member declares and acknowledges to have read the present terms and conditions in their entirety.
The member agrees to be bound by the present terms and conditions of use. Use of the «direct-booking.com» site is not recommended for those who are not in agreement.
In addition, use of any of the services made available through the website at: « http://www. direct-booking.com / » (hereinafter the « direct-booking.com » site) carries unconditional acceptance by the member of the present terms and conditions.
The company reserves the right to modify at any time, in whole or in part, these Terms and Conditions. The member is deemed to accept each updated version of said terms further to subsequent access to the site.
Article 2. Description of services
Direct Booking facilitates direct interaction between hotels and site members in order to optimize the final price or conditions of a client's accommodation. These Services are accessible through the website at www.direct-booking.com
2.1 Member requests
Registration of an account with the « direct-booking.com.com » site enables members to send direct requests to hotels without having to provide personal details. Requests cannot be made to hotels without prior registration of a member account. Requests are limited to 3 per 24 hours. Members make direct booking requests to hotels, indicating desired services, in a confidential and secure environment and using an innovative system developed by Direct Booking.
2.2 Hotel offers
This service enables Direct Booking members to receive personalized special offers from hotels in accordance with their selected criteria, using the system developed by the latter.
2.3 Management
This service puts at member's disposal a real time interface for the management of his or her offers, bookings and member account.
Article 3. Reservations
Online reservations can be made at http://www. direct-booking.com » Reservations will only be deemed as accepted further to acceptance of the Terms of Use and payment of the service fees. To confirm a reservation, 5% service fees are charged to members on each reservation. The total amount of the booking is payable directly to the hotel in local currency. The reservation of special offers is strictly reserved for members registered with the site by means of a Facebook API.
The Customer shall:
- Submit all information requested throughout the reservation process.
- Verify all information prior to confirming a reservation
- Provide relevant contact information.
- Accept the Terms of Use.
- Pay the service fees for reservation confirmation.
Reservation Confirmation
Once a member has confirmed a reservation, a reservation agreement is created directly between the hotel and the client.
Once payment has been processed, the confirmation is issued to both the customer and the hotel by email, confirming all reservation details, including services booked and total price.
Right of Withdrawal
The reservation of an offer is not subject to right of withdrawal. Nevertheless, it is subject to the cancellation conditions contained herein.
Article 4. Payment
The price of an offer includes certain inclusive services. Prices include all taxes and are quoted in Euros. Service fees are payable through the site in Euros.
Local taxes
In certain countries, the payment of additional local taxes may be required. In said event, taxes must be paid directly to the hotel. Said local taxes are the responsibility of the customer unless otherwise indicated in the offer.
Price Reviews
All quoted prices are provided by hotels in accordance with selected dates and are only valid at the time of booking.
Payment Terms
Service fees are payable at the point of reservation and required for the hotel booking confirmation. The total amount of the booking is payable directly to the hotel in local currency. Any incurred charges not covered by the offer are the responsibility of the customer and must be paid at the hotel prior to departure.
Article 5. Cancellation Policy
The booking entails the acceptance, by the client, of the cancellation policy. Cancellation and no show conditions are detailed in the hotel offer. Hotels must specify them for each offer they propose. Cancellation conditions are also detailed in the email confirmation issued to the client. Cancellation terms are managed directly between the client and the hotel. Cancellation conditions are applicable in accordance with local time at the point of destination. Service fees are non-refundable.
Direct-Booking cannot be held responsible if those conditions were not met, nor in the event of litigation between the hotel and the client.
Article 6. Liability and Warranties
6.1. Network Operations
Given the specific features of an online network, the company offers no guarantee of continuity of service, and they are held in this regard only to an obligation of duty of care.
6.2 Site Modifications
All content contained within the « http://www. direct-booking.com » site may be modified without liability at any point without prior notification, taking into account site interactivity.
The company does not guarantee the precision of information and prices published by the providers listed on its site. It is the responsibility of the member to carry out any checks deemed necessary, such as verifying information on hotel websites.
6.3. Member Guarantees
The member declares that he is aware of the nature and constraints of an online network and he acknowledges that it is impossible to completely guarantee the security of data transmission. The company is not liable for any incidents which may arise to this effect. Nonetheless, the company assures that all means to their disposal are used in order to ensure maximum possible levels of security are maintained.
6.4. Hyperlinks
The « direct-booking.com » site contains links to third party websites. Linked sites are not under the control of the company and they are not liable for any content contain in said sites. The « direct-booking.com » site provides these links for member convenience only.
6.5. Services Provided by Hotel
The company in no way guarantees the services and/or business practices of hotels. To this effect, the company is unable to guarantee customer satisfaction resulting from services and/or business practices obtained further to any reservation made throughout the « direct-booking.com » site.
Article 7. Member obligations
7.1. Acceptance, without limitation, of the present terms and conditions
The member accepts, expressly and without limitation, the terms of the present general conditions and those conditions arising from the subsequent navigation through the site.
7.2 The provision of accurate, true information
The member is obliged to provide accurate and true information for the purposes of identification throughout the account registration process and at the point of reservation.
